Plain-language answers

Start with the main questions

Barbados has child-maintenance provisions under more than one law. The appropriate court and application depend on the family relationship and the orders sought.

What is child maintenance?

Maintenance can include money, property and services provided for a child. Under the Maintenance Act it includes provision toward education and training, subject to the Act’s scope.

Are both parents responsible?

Barbados authority recognizes that both parents may be liable to maintain their child according to their financial resources. The applicable law and facts determine how an application is handled.

Which court handles an application?

The Maintenance Act defines the court as a Magistrates’ Court, while the Family Law Act contains separate maintenance provisions handled within the Supreme Court’s family jurisdiction. Contact the relevant court or qualified Barbados counsel to confirm the proper route.

Can custody and access also arise?

When hearing an application within the Maintenance Act, a magistrate may examine guardianship, custody, access and visitation arrangements. The child’s welfare or best interests are central to child-related decisions.

Do expense records determine the amount?

No. Receipts and payment records can help organize relevant facts, but they do not create an order or determine the amount. The court applies the relevant law to the evidence and circumstances.

A practical starting path

How can I begin?

The official sources do not present one universal filing sequence for every family. Use these preparation steps, then confirm the exact process with the court.

  1. Identify the likely court

Review the Magistrates’ Courts directory and the Supreme Court Registry information. Ask which court and legislation apply to your family circumstances.

  2. Confirm the current requirements

Ask the court office for the current application form, fees, supporting documents, filing method and service instructions.

  3. Organize relevant information

Prepare existing orders, the child’s needs, income and expense information, payment history and any other records the court requests.

  4. Follow the court’s directions

File and serve documents as instructed, attend scheduled proceedings and keep copies of filed documents and resulting orders.

Practical preparation

What records may be useful?

This is an organizational checklist, not an official list of required evidence.

  1. Existing maintenance, custody, care and control, access or guardianship orders and agreements.
  2. A dated list of the child’s regular and exceptional expenses, supported by available receipts.
  3. A clear record of relevant payments made or received, including date, amount, method and purpose.
  4. Income and financial information requested by the court.
  5. Relevant education, childcare, medical, transport or other records concerning the child’s needs.
