LEGAL

Terms of Use

Effective: October 7, 2026

1. Acceptance of Terms

These Terms of Use constitute a binding agreement between you and the person or business identified in the Contact section as the provider of Zuko. By creating an account, accepting these Terms, accessing Zuko, or using the service, you agree to these Terms, the Privacy Policy, the Refund and Cancellation Policy, and any additional terms presented for a specific feature, campaign, promotion, or service. If you do not agree, you must not create an account or use Zuko.

2. Purpose of Zuko

Zuko provides software tools intended to support structured co-parenting communication, scheduling, parenting-time coordination, requests, child profiles, protected medical information, expense tracking, document management, accountability records, reports, and related activities. Zuko is a technology platform. It does not function as a court, mediator, therapist, parenting coordinator, healthcare provider, law firm, financial adviser, emergency service, or legal representative.

3. Eligibility and Adult Use

You must be legally capable of entering into a binding agreement and must meet the minimum age requirements applicable in your jurisdiction. Zuko is intended for use by adults. Children must not create accounts, accept these Terms, or submit information directly to Zuko. You must provide accurate registration information and must not create an account using another person’s identity or without appropriate authorization.

4. Licence to Use Zuko

Subject to these Terms, Zuko grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable licence to access and use the service for lawful personal or authorized organizational purposes. You may not:

  • Copy, sell, rent, sublicense, distribute, or commercially exploit Zuko except where expressly authorized.
  • Reverse-engineer, decompile, disassemble, or attempt to derive Zuko’s source code except where such a restriction is prohibited by law.
  • Modify, adapt, interfere with, or create unauthorized derivative works from the service.
  • Use automated systems to scrape, extract, overload, probe, or interfere with the service.
  • Remove proprietary notices or misrepresent ownership of Zuko.
  • Use the service in a manner inconsistent with applicable app-store, device, network, or third-party terms.

All rights not expressly granted are reserved.

5. No Legal or Professional Advice

Zuko does not provide legal advice, medical advice, mental-health services, counselling, mediation, financial advice, parenting advice, or professional recommendations. Information, reports, exports, summaries, records, reminders, suggestions, notifications, size conversions, artificial-intelligence guidance, or other materials generated through Zuko are organizational tools only. You should obtain advice from an appropriately qualified professional where legal, medical, financial, safety, or other professional guidance is required.

6. Child Profiles and User Authority

Authorized adult users may create profiles and enter information about children for legitimate parenting, caregiving, scheduling, documentation, and record-management purposes. By entering, uploading, editing, sharing, or linking information about a child, you represent that:

  • You are authorized to possess and use the information.
  • You are authorized to provide it to Zuko.
  • Your use of the information is lawful and connected with legitimate parenting or caregiving purposes.
  • You will not knowingly enter false, misleading, excessive, or unlawfully obtained information.
  • You will consider the child’s privacy and best interests when deciding what information to store.

Zuko does not determine custody, guardianship, parental responsibility, access rights, decision-making authority, or whether one user has greater legal authority than another. Workspace roles, child links, editing permissions, read-only access, notifications, and other product controls are technical features. They do not create, change, or override a court order, parenting agreement, legal right, or legal obligation.

7. Protected Medical and Health Information

Eligible users may choose to store information about a child’s allergies, conditions, medications, blood type, measurements, care notes, medical documents, appointments, and related health matters. Users are responsible for ensuring that medical information they enter is accurate, current, relevant, and lawfully provided. Zuko:

  • Does not verify medical information.
  • Does not obtain medical information directly from healthcare providers unless an authorized user uploads or enters it.
  • Does not provide a medical record maintained by a healthcare professional.
  • Does not diagnose, treat, monitor, or recommend treatment for any condition.
  • Does not guarantee that another authorized user will review or act upon the information.
  • Must not be relied upon as the only location for critical medical or emergency information.

In an emergency or where urgent medical attention is required, users must contact appropriate emergency services or qualified healthcare professionals. Zuko is not an emergency communication service.

8. Sizes, Conversions, and Practical Child Information

Zuko may allow users to record shirt, bottom, shoe, school, measurement, and other practical information about a child. Any size conversion, category comparison, or similar value shown by Zuko is approximate and is provided for convenience only. Sizes may differ by brand, manufacturer, region, age, body type, product, and sizing system. Users should verify measurements and product-specific sizing before making a purchase or relying on a conversion. Zuko is not responsible for inaccurate fit, unsuitable purchases, or decisions made from approximate conversions.

9. Account Responsibility

You are responsible for:

  • Providing accurate and current account information.
  • Protecting your password and authentication credentials.
  • Maintaining control of your email account and devices.
  • Securing authenticated sessions.
  • Configuring application-lock, biometric, notification, and device-security settings appropriately.
  • Promptly notifying Zuko of suspected unauthorized access.
  • Ensuring that activity performed through your account is authorized.

Activity performed through an authenticated account may be treated as activity authorized by the account holder unless Zuko has been notified of a security concern and has had a reasonable opportunity to respond. You must not share authentication codes, passwords, session tokens, or other security credentials.

10. User Content and Responsibility

Users retain ownership of the lawful content they create or upload. You are solely responsible for messages, photographs, documents, medical information, child information, requests, schedules, expenses, parenting-time records, accountability records, notes, reports, and other content you enter, upload, create, send, or share. You represent that you possess the rights, permissions, and legal authority necessary to store, process, and share that content through Zuko. You grant Zuko a limited licence to host, store, reproduce, process, transmit, display, synchronize, protect, and otherwise use your content only as reasonably necessary to:

  • Operate the service.
  • Provide requested features.
  • Make authorized shared records available.
  • Generate requested documents and reports.
  • Provide support.
  • Investigate technical or safety issues.
  • Enforce these Terms.
  • Comply with applicable law.

This licence continues for retained shared, safety, billing, audit, backup, or legally required records after account closure where permitted by these Terms and the Privacy Policy.

11. Workspaces, Connections, and Sharing

Zuko uses authenticated accounts, co-parent connections, workspace memberships, child links, roles, plan entitlements, and access controls to determine access. Information identified as shared may be visible to the connected coprogenitor or other authorized participants. Information identified as private or limited to its creator will not ordinarily be made available to another user unless the applicable feature states otherwise or disclosure is required for safety, support, security, or legal compliance. Before submitting information, users should review whether the applicable feature is private, shared, creator-scoped, read-only, or protected. A user’s subscription level may affect their ability to create or edit certain records. Access to shared information created under another authorized user’s plan may be available on a read-only or otherwise limited basis.

12. Child and Medical Access Controls

General child-profile information may be available to authorized participants connected to the child through an active workspace. Editing, archiving, deletion, and other management permissions may depend on the user’s relationship, role, connection, plan, and applicable product controls. Protected medical information may require biometric authentication, a PIN, device passcode, or another supported security method. A successful device-security check confirms access to the device or account; it does not determine legal authority over the child. Documents added through the protected medical area inherit the applicable child access scope while stored in Zuko. Once a user downloads, exports, copies, photographs, forwards, or otherwise shares information outside Zuko, Zuko cannot control the external copy. Users must not attempt to bypass access controls or obtain child or medical information they are not authorized to access.

13. Local Storage and Offline Access

The mobile application may maintain an authorized local copy of previously synchronized information and pending changes. Offline information may not reflect the most recent server state or changes made by another participant. Users should allow synchronization to complete before relying on time-sensitive information. Signing out, reinstalling the application, clearing application data, changing devices, losing a device, database recovery, or a failed synchronization may affect locally stored information or pending changes. Users are responsible for securing devices that contain locally stored Zuko information.

14. Acceptable Use

You must not use Zuko to:

  • Harass, threaten, intimidate, stalk, abuse, exploit, or endanger another person.
  • Upload unlawful, malicious, deceptive, defamatory, infringing, or harmful content.
  • Impersonate another person or misrepresent your authority.
  • Access another account, workspace, child profile, document, or record without authorization.
  • Circumvent security, subscription, access, reporting, or safety controls.
  • Introduce malware, destructive code, or harmful files.
  • Interfere with platform operation or impose an unreasonable technical burden.
  • Falsify, manipulate, or misuse records, reports, timestamps, or audit information.
  • Use Zuko to violate a court order, legal restriction, or applicable law.
  • Submit knowingly false or abusive safety reports.
  • Use information obtained through Zuko to facilitate harm, discrimination, fraud, or unlawful surveillance.
  • Collect or disclose information about a child without appropriate authority.
  • Attempt to identify vulnerabilities without prior written authorization.

15. Safety Reports and Blocking

Zuko provides tools to report received messages and block direct messaging. Reports must be made honestly and in good faith. Zuko may review reports, preserve relevant records, request additional information, restrict messaging, remove content where appropriate, suspend or terminate accounts, and take other reasonably necessary measures to protect users and the service. Blocking messaging may prevent future direct communication through the applicable conversation, but it does not necessarily remove historical records or prevent access to unrelated shared workspace functions. Zuko does not guarantee that it will resolve disputes between users or determine whether allegations are legally proven. Safety reporting through Zuko is not a replacement for contacting emergency services, law enforcement, child-protection services, legal counsel, or other appropriate authorities where there is an immediate risk of harm.

16. Structured Records, Reports, and Exports

Zuko provides tools intended to organize information and create structured records, reports, summaries, and exports. Zuko does not guarantee that any message, report, export, schedule, screenshot, expense record, parenting-time record, medical record, document, audit record, or other material will be:

  • Complete or error-free.
  • Accepted as accurate by another user.
  • Admissible in court.
  • Accepted by an attorney, mediator, healthcare provider, government agency, school, employer, financial institution, or other third party.
  • Sufficient to prove a legal, medical, financial, or factual claim.
  • Available indefinitely.

Users are responsible for reviewing generated materials and maintaining independent copies of information they consider important.

17. AI-Assisted Message Review

Zuko may provide optional artificial-intelligence features that analyze a draft message and offer tone guidance or suggested wording. AI-generated guidance:

  • May be incomplete, inaccurate, inappropriate, or unsuitable for the circumstances.
  • Does not constitute legal, therapeutic, safety, parenting, or professional advice.
  • Does not determine whether a message is lawful, fair, safe, or appropriate.
  • Does not send a message on the user’s behalf.
  • Must be reviewed by the user before use.

The user remains solely responsible for the final message and the decision to send it. Users must not submit content to the AI feature that they are not authorized to process or that is unnecessary for the requested review.

18. Diagnostics, Support, and Administrative Access

Zuko may collect technical diagnostics and receive user-submitted problem reports as described in the Privacy Policy. Authorized personnel may access limited account, subscription, workspace, device, diagnostic, campaign, or safety information where reasonably necessary to:

  • Provide support.
  • Investigate blocked startup, failed synchronization, loading, recovery, upload, or other operational problems.
  • Maintain security and service reliability.
  • Administer billing or campaign benefits.
  • Review safety concerns.
  • Enforce these Terms.
  • Comply with applicable law.

Administrative access is subject to assigned roles, scopes, access controls, and applicable auditing. Submitting a problem report authorizes Zuko to use the supplied technical and troubleshooting information to investigate the reported issue. Users must not include passwords, authentication codes, full payment-card information, or unnecessary sensitive information. Zuko does not guarantee that every reported problem can be reproduced, diagnosed, or resolved.

19. Subscriptions, Billing, and Renewals

Certain features require a paid subscription or other qualifying entitlement. The available plans, prices, limits, billing periods, currencies, trial periods, renewal terms, and included features are displayed through the applicable purchase flow and may vary by platform, country, storefront, campaign, or payment provider. Unless otherwise stated, subscriptions automatically renew until cancelled through the provider that manages the subscription. Cancelling a subscription generally stops future renewal. Cancellation does not ordinarily create an automatic refund and may allow access to continue until the end of the paid period. A subscription may remain active until its expiration date even when renewal has been cancelled. Refunds, revocations, chargebacks, failed payments, grace periods, and billing recovery may affect access. The Refund and Cancellation Policy at https://www.zukofamilies.com/refund-policy forms part of these Terms.

20. App-Store and Third-Party Payments

Purchases made through Apple, Google, PayPal, WiPay, or another provider are also subject to that provider’s terms, billing rules, refund procedures, and privacy practices. Zuko may rely on purchase and subscription information supplied by the provider when granting, renewing, limiting, or revoking access. Users are responsible for:

  • Maintaining a valid payment method.
  • Reviewing the price and renewal information shown by the provider.
  • Managing subscriptions through the provider that processed the purchase.
  • Cancelling through that provider when required.
  • Complying with applicable provider terms.

Closing a Zuko account does not automatically cancel a subscription managed by Apple, Google, or another payment provider. Zuko may correct an entitlement where a purchase is refunded, revoked, charged back, cancelled, expired, fraudulent, assigned to the wrong account, or otherwise invalid.

21. Plan Changes and Feature Access

Plan features and limits may change where permitted by law. Zuko will provide notice of material changes where required. When a paid plan expires, is cancelled, is revoked, or returns to a lower plan:

  • Paid features may become unavailable.
  • Creation or editing of additional records may be restricted.
  • Certain information may remain visible on a read-only basis.
  • Shared information may remain available to another authorized participant.
  • Existing records may be preserved rather than automatically deleted.
  • Re-subscribing may restore eligible functionality.

Zuko does not guarantee continued access to features outside the user’s active plan or entitlement.

22. Partner Campaigns, Promotions, and Trials

Zuko may offer partner campaigns, promotional access, sponsored plans, trials, discounts, offer codes, feedback programs, or other limited benefits. These offers may be subject to eligibility criteria, enrollment requirements, participant limits, expiration dates, partner verification, connection requirements, and campaign-specific terms. Zuko may withhold, revoke, correct, or end a campaign benefit where:

  • Eligibility requirements are not met.
  • Required participants do not enroll.
  • An invitation or campaign expires.
  • Information is inaccurate or misleading.
  • Duplicate, fraudulent, abusive, or unintended use is detected.
  • The campaign is suspended, closed, or changed.
  • A technical or administrative error granted access incorrectly.

Submitting testimonial text permits its use only as explained in the applicable campaign form. Permission to publish a participant’s name must be obtained separately. Without that permission, an approved testimonial must be used anonymously. Campaign-specific terms and privacy notices supplement these Terms.

23. Privacy

Zuko’s collection, use, sharing, protection, and retention of personal information are described in the Privacy Policy at https://www.zukofamilies.com/privacy. By using Zuko, you acknowledge the Privacy Policy. Acceptance of these Terms does not create consent for optional marketing. Marketing consent is collected and managed separately.

24. Record Retention and Shared Data

Zuko may retain information where reasonably necessary for:

  • Service operation.
  • Synchronization and shared-record continuity.
  • Support and diagnostics.
  • Audit history.
  • Document and report access records.
  • Subscription and transaction management.
  • Fraud prevention.
  • Safety investigations.
  • Backups.
  • Dispute resolution.
  • Legal compliance.
  • Platform security.

Messages, child profiles, medical information, documents, requests, events, expenses, parenting-time information, and other shared records may remain available to authorized workspace participants after a user disconnects, changes plans, loses access, or closes an account. Zuko may delete, anonymize, aggregate, archive, or restrict information when identifiable or active information is no longer required. Additional retention information is provided in the Privacy Policy.

25. Account Closure

You may request closure of your account through the available account settings. A ten-day cancellation period begins when the request is submitted. During that period, you may sign in and cancel the request. After the cancellation period:

  • Access may be permanently revoked.
  • Personal profile and authentication information may be deleted or anonymized.
  • Locally stored information may become unavailable.
  • The closure may not be reversible.
  • Shared records may remain available to other authorized participants.
  • Billing, transaction, legal-acceptance, safety, security, diagnostic, audit, fraud-prevention, backup, and legally required records may be retained.

Closing a Zuko account does not automatically cancel an Apple, Google, PayPal, WiPay, or other provider-managed subscription. You remain responsible for cancelling the subscription through the applicable provider.

26. Availability, Synchronization, and Changes to the Service

Zuko is provided on an available and as-is basis, subject to applicable law. Zuko does not guarantee uninterrupted availability, immediate synchronization, successful delivery of every notification or email, continuous offline access, permanent preservation, error-free operation, or compatibility with every device or third-party service. Interruptions or delays may result from:

  • Maintenance.
  • Software defects.
  • Device limitations.
  • Network failures.
  • Third-party provider failures.
  • App-store delays.
  • Security incidents.
  • Legal requirements.
  • Force majeure events.
  • Other circumstances outside Zuko’s reasonable control.

Zuko may modify, add, restrict, suspend, or discontinue features where reasonably necessary. Where required by law, Zuko will provide appropriate notice of material changes.

27. User Backups and External Copies

Users are responsible for maintaining independent copies of information they consider important. Zuko does not guarantee permanent recovery or preservation of user content, locally pending changes, exported reports, downloaded documents, or information stored on third-party devices or services. Once information is downloaded, exported, photographed, printed, emailed, or shared outside Zuko, its security and use are controlled by the recipient, device, platform, or service receiving it.

28. Intellectual Property

Zuko’s software, branding, trademarks, interfaces, designs, workflows, documentation, text, graphics, databases, and related intellectual property are owned by Zuko or its licensors. Users retain ownership of their lawful user content but do not acquire ownership of Zuko’s software or intellectual property. If a third party claims that the Zuko application or an authorized user’s possession and use of it infringes that third party’s intellectual property rights, Zuko—not Apple—is responsible for investigating, defending, settling, or discharging the claim to the extent required by applicable law and Apple’s minimum EULA terms.

29. Suspension, Restriction, and Termination

Zuko may suspend, restrict, or terminate access where reasonably necessary because of:

  • A violation of these Terms.
  • Suspected fraud or unauthorized access.
  • Harassment, threats, abuse, or safety concerns.
  • Misuse of child or medical information.
  • Circumvention of technical or subscription controls.
  • Harm to another user or the service.
  • Non-payment, refund, revocation, or chargeback.
  • A legal or regulatory requirement.
  • Security or operational risk.

Where appropriate, Zuko may provide notice or an opportunity to correct the issue. Immediate action may be taken where necessary to protect users, children, records, security, or service integrity. Suspension or termination does not automatically delete shared records or remove obligations incurred before termination.

30. Disclaimer of Warranties

To the maximum extent permitted by applicable law, Zuko is provided “as is” and “as available,” without warranties of uninterrupted operation, merchantability, fitness for a particular purpose, accuracy, non-infringement, data preservation, or suitability for a particular legal, medical, parenting, financial, or personal outcome. Zuko does not warrant that:

  • Information entered by users is accurate or complete.
  • Another participant will respond, cooperate, or comply with an agreement.
  • Notifications, reminders, reports, or synchronization will always occur on time.
  • Records will be accepted by a court or third party.
  • Medical or child information will be current.
  • AI guidance or size conversions will be accurate.
  • The service will meet every user’s needs.

Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.

31. Limitation of Liability and Indemnification

To the maximum extent permitted by applicable law, Zuko and its owners, officers, employees, contractors, affiliates, service providers, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to:

  • Use or inability to use the service.
  • Loss of data or unsynchronized changes.
  • Parenting, custody, access, financial, medical, legal, or personal decisions.
  • Conduct of another user.
  • Reliance on reports, records, reminders, AI guidance, or size conversions.
  • Unauthorized access outside Zuko’s reasonable control.
  • Third-party services or payment providers.
  • Loss of opportunity, revenue, reputation, or anticipated benefit.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law. To the extent permitted by law, you agree to indemnify and hold harmless Zuko and its owners, employees, contractors, affiliates, service providers, and partners from claims, losses, liabilities, damages, expenses, and reasonable legal costs arising from: - Your unlawful conduct. - Your user content. - Your lack of authority to provide or share information. - Your misuse of child or medical information. - Your violation of these Terms. - Your infringement of another person’s rights. - Your violation of applicable law. This indemnity does not apply to the extent a claim results from Zuko’s own unlawful conduct or where indemnification is prohibited by law.

32. Apple App Store Terms

For versions of the Zuko application obtained through Apple’s App Store:

  • These Terms are between you and the Zuko application provider, not Apple. Zuko, and not Apple, is responsible for the application and its content.
  • You receive a non-transferable licence to use the application on Apple-branded products that you own or control, as permitted by the Apple Media Services Terms and Conditions and applicable Usage Rules, including permitted Family Sharing or volume-purchase access.
  • Zuko is responsible for maintenance and support for the application. Apple has no obligation to provide maintenance or support.
  • To the extent any warranty applies and the application fails to conform to it, you may notify Apple. Apple may refund the purchase price, if any, paid for the application. To the maximum extent permitted by law, Apple has no other warranty obligation concerning the application.
  • Zuko, not Apple, is responsible for addressing claims relating to the application or its possession or use, including product-liability, regulatory, consumer-protection, and privacy claims.
  • Zuko, not Apple, is responsible for investigating, defending, settling, and discharging claims that the application infringes a third party’s intellectual property rights.
  • You represent that you are not located in a country subject to a United States Government embargo or designated by the United States Government as supporting terrorism, and that you are not listed on a United States Government list of prohibited or restricted parties.
  • You must comply with applicable third-party terms when using the application, including telecommunications, internet, device, payment, and Apple service terms.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple has the right to enforce the applicable provisions against you as a third-party beneficiary.

33. Disputes Between Users

Zuko is not responsible for resolving disputes, disagreements, parenting decisions, financial disputes, custody matters, medical disagreements, communication conflicts, emotional outcomes, or legal proceedings between users. Zuko may provide technical controls, safety tools, records, and support, but does not act as a neutral adjudicator and does not determine which participant is factually or legally correct. Users should seek appropriate professional or legal assistance where a dispute cannot be resolved safely and lawfully.

34. General Legal Terms

These Terms, together with incorporated policies and applicable supplemental terms, constitute the agreement governing use of Zuko. If any provision is found invalid or unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will remain in effect. A failure by Zuko to enforce a provision does not waive the right to enforce it later. You may not assign or transfer your account or rights under these Terms without prior written permission. Zuko may assign these Terms as part of a legitimate merger, acquisition, financing, restructuring, or transfer of the service. Headings are provided for convenience and do not limit the meaning of a provision. No person other than the parties has a right to enforce these Terms except where expressly stated, including Apple’s rights under the Apple App Store Terms section.

35. Governing Law, Changes, and Contact

These Terms are governed by and interpreted according to the laws of Trinidad and Tobago, without regard to conflict-of-law principles, except where mandatory laws in the user’s jurisdiction apply. Zuko may update these Terms to reflect changes in the service, features, data practices, providers, security controls, legal requirements, or business operations. When a material revision is published, Zuko will update the version and effective date and may provide notice or require users to accept the revised Terms. Continued use after the effective date of revised Terms constitutes acceptance where permitted by law.
