Terms of Use

1. Acceptance of Terms

By accessing or using Zuko, you agree to these Terms of Use. If you do not agree with these terms, you should not use the service.

2. Purpose of Zuko

Zuko provides tools intended to support structured co-parenting communication, scheduling, requests, visitation workflows, documentation, expense tracking, record management, and related activities. Zuko is software and does not function as a court, mediator, therapist, parenting coordinator, law firm, or legal representative.

3. Eligibility

You must be legally capable of entering binding agreements and meet the minimum age requirements applicable within your jurisdiction to create an account or use the service.

4. Not Legal Advice

Zuko does not provide legal advice, parenting advice, mediation services, therapy services, legal representation, or professional recommendations. Information, reports, exports, summaries, records, or notifications generated through Zuko should not be relied upon as professional advice.

5. Account Responsibility

Users are responsible for maintaining accurate account information, protecting login credentials, controlling access to their devices, and maintaining account security. Activities performed through authenticated accounts may be treated as authorized activity.

6. User Content and Responsibility

Users remain solely responsible for messages, documents, records, expenses, images, requests, schedules, visitation records, and any information uploaded or created within Zuko. Users represent that they possess the authority and legal right to upload, store, and share such information.

7. Acceptable Use

Users agree not to misuse the platform, harass other users, upload malicious content, attempt unauthorized access, circumvent security mechanisms, interfere with platform operations, impersonate others, violate laws, or use Zuko in ways that create harm to others or the service.

8. Structured Records Disclaimer

Zuko provides tools intended to organize communication and records. Zuko does not guarantee that messages, exports, reports, schedules, screenshots, visitation logs, or records generated through the platform will be admissible, accepted, or relied upon by courts, attorneys, government agencies, employers, or third parties.

9. Disputes Between Users

Zuko is not responsible for disputes, disagreements, parenting decisions, legal proceedings, financial disputes, custody matters, emotional outcomes, communication conflicts, or interactions between users.

10. Subscriptions and Billing

Certain functionality requires paid subscriptions. Pricing, feature availability, limits, and subscription structures may change periodically. Cancelling a subscription stops future renewals but does not automatically refund a charge already made. Eligibility, exclusions, request procedures, and the distinction between direct web, Apple App Store, and Google Play purchases are explained in Zuko's Refund and Cancellation Policy at https://www.zukofamilies.com/refund-policy, which forms part of these Terms. Subscriptions purchased through third-party marketplaces are also governed by the applicable marketplace terms, refund procedures, and mandatory consumer laws.

11. Record Retention and Access

Zuko may retain records for operational integrity, backups, audit history, document and generated-report access records, fraud prevention, legal compliance, or service continuity. When a user requests account closure, the account is scheduled for permanent closure after a 10-day review window. During that window, the user may sign in and cancel the request. After the window ends, personal profile and authentication information is anonymized or deleted, access is revoked, and active subscriptions are ended. Shared workspace records, billing and transaction records, legal acceptances, safety records, and other information may be retained where reasonably necessary for authorized participants, operational integrity, audit history, dispute resolution, fraud prevention, legal compliance, or service continuity.

12. Availability and Interruptions

Zuko is provided on an as-available basis. Availability, synchronization timing, exports, notifications, backups, uptime, and access cannot be guaranteed. Interruptions may occur because of maintenance, infrastructure failures, third-party providers, force majeure events, or technical limitations.

13. User Backups

Users remain responsible for maintaining copies of information they consider important. Zuko does not guarantee permanent availability, recovery, or preservation of user content.

14. Intellectual Property

Zuko branding, software, workflows, interfaces, designs, documentation, and related intellectual property remain the property of Zuko or its licensors. Users retain ownership of information uploaded into the platform.

15. Limitation of Liability

To the maximum extent permitted by law, Zuko and its owners, contractors, affiliates, employees, service providers, and partners are not liable for indirect damages, legal outcomes, custody outcomes, emotional distress, financial losses, lost opportunities, loss of data, parenting disputes, or damages arising from use or inability to use the service.

16. Indemnification

Users agree to indemnify and hold harmless Zuko, its owners, employees, contractors, affiliates, service providers, and partners from claims, disputes, losses, liabilities, damages, expenses, or legal actions arising from user conduct, uploaded content, misuse of the service, legal disputes, or violations of applicable law.

17. Suspension and Termination

Zuko reserves the right to suspend, restrict, or terminate accounts that violate these terms, create operational risk, misuse the service, fail to maintain subscription obligations, or create harm to users or the platform.

18. Account Closure

You may request closure of your Zuko account through the available account settings. Closure is scheduled for 10 days after the request so you have an opportunity to change your mind. You may cancel the request by signing in during this period. Once the 10-day window ends, the closure process is permanent and cannot be undone. Closing a Zuko account does not automatically cancel a subscription purchased through an app store or other payment provider; you remain responsible for cancelling that subscription through the provider to prevent future charges.

19. Severability

If any portion of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

20. Changes to Terms

These Terms may be updated periodically. Continued use of Zuko after updates are published constitutes acceptance of revised terms.

21. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Trinidad and Tobago without regard to conflict of law principles.

22. Contact

Questions regarding these Terms may be submitted through official support channels provided by Zuko. Safety concerns, reports of harassment or threats, and concerns about abusive use of the service may be sent to [email protected].

23. Safety Reports and Blocking

Zuko provides tools to report received messages and block direct messaging. Users must not use Zuko to harass, threaten, intimidate, abuse, or endanger another person. Zuko may review reports, preserve relevant records, restrict messaging, remove content where appropriate, suspend or terminate accounts, and take other measures necessary to protect users and the service. Reports should be submitted honestly and do not replace contacting local emergency services when there is an immediate risk of harm.

24. Partner Campaigns and Trial Programs

Zuko may offer short-term partner campaigns, promotional trials, and feedback programs subject to campaign-specific terms and eligibility rules. Campaign invitations, trial access, and store offers may be limited, expire, or be withdrawn where required to prevent duplicate or abusive use. When a participant submits testimonial text through a campaign feedback program, that submission gives Zuko permission to use the testimonial. The participant separately chooses whether Zuko may use their name with it; otherwise it is used anonymously. Zuko may record campaign email delivery and approximate engagement metrics for campaign reporting as described in the applicable campaign privacy notice. A campaign-specific privacy notice may supplement these Terms. Participation does not change the rules that apply to Zuko accounts, workspaces, subscriptions, shared records, safety controls, or account closure.
